1. Agreement

These Terms of Service ("Terms") govern your use of the FunPixel iOS app and the website at funnypixcel.com (together, the "Service"), provided by FunPixel LLC ("FunPixel", "we", "us"). By using the Service, you agree to these Terms.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial use, subject to these Terms and Apple's standard EULA.

3. Acceptable use

You agree not to use the Service to:

Process content that infringes anyone's copyright, privacy, or publicity rights.
Generate, restore or modify imagery depicting minors in a sexualized context, or any other content prohibited by law.
Reverse engineer, decompile, or attempt to extract the underlying AI models or our prompts.
Interfere with the Service, including evading rate limits, scraping, or abusing free-tier quotas.

We may suspend or terminate access for any device that materially violates these rules.

4. Subscriptions and refunds

Premium features are sold as auto-renewing subscriptions through the Apple App Store. Pricing, renewal cadence and free-trial terms are shown to you before purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the period ends. Refunds are handled by Apple — request one at reportaproblem.apple.com.

5. AI provider behavior

The Service relies on third-party AI providers (Google Gemini, OpenAI). Output quality, processing time and content filters are controlled by those providers and may change over time. Some submissions may be blocked by provider safety filters; we do not control or appeal those decisions on your behalf.

6. Content ownership

You keep all rights to the photos you submit. By using the Service, you grant FunPixel and its AI providers a limited license to process those photos solely to deliver the requested edit. We do not claim ownership of your photos or generated results, do not use them to train AI models, and delete them within 48 hours.

7. Disclaimer

The Service is provided "AS IS", without warranties of any kind, express or implied. We do not warrant that processing will always succeed, that results will meet your expectations, or that the Service will be uninterrupted or error-free.

8. Limitation of liability

To the maximum extent permitted by law, FunPixel and its officers, directors and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data or revenue, arising from your use of the Service. Our total liability for direct damages will not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

You may stop using the Service at any time by deleting the app. We may discontinue features or terminate access to specific devices that violate these Terms or applicable law.

10. Governing law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles. Disputes will be resolved in the state and federal courts located in Wyoming, except where local consumer protection law requires otherwise.

11. Changes

We may update these Terms; the updated version takes effect on the date shown above. Material changes will be announced in-app.
